| Official Rules for the Kolvane Honorary Members Sweepstakes No Purchase Necessary to enter or win. A purchase will not increase your chances of winning. 1. CAN I PARTICIPATE? Open to all legal residents of the fifty (50) United States and the District of Columbia who are 21 years or older as of September 7, 2007 except as provided in paragraph 6 below. 2. HOW DO I ENTER? This promotion begins at 9:30 pm on Friday September 7, 2007 and ends at 11:00 pm on Friday September 7, 2007. To enter: You must present your Honorary Member ID Card at the designated drawing desk to receive a raffle ticket. You must write your Honorary Member ID # and last name legibly on the raffle ticket. Limit one entry per person. Multiple entries submitted by a single entrant are void. Misdirected, lost, late, mutilated or illegible entries are not the responsibility of Sponsor, and are void. False or deceptive entries or acts will render the entrant ineligible. Participants who disregard these Official Rules may be declared ineligible. All entries become the property of the Sponsor and will neither be returned nor acknowledged. You may receive your Honorary Member ID Card via mail or at the drawing site after 8 pm on September 7, 2007. To receive an Honorary Member ID card via mail, sign up online through www.Kolvane.com or www.RoseCityKings.com supplying a complete postal address. If you do not receive your Honorary Member ID in the mail, you may register at the designated drawing desk at the drawing site for an Honorary Member ID card by supplying a legible and complete postal address prior to the applicable drawing. 3. WHAT CAN I WIN? 1 Grand Prize: VIP Package -- One night hotel stay (standard room, double occupancy, hotel selected by Sponsor) and two guest passes for either Kolvane’s November 2, 2007 show at Biscuits & Blues in San Francisco, CA, or Kolvane’s December 8, 2007 show at Highway 99 Blues Club in Seattle, WA. Approximate retail value: $200. 1 autographed Jay Turser guitar. Approximate retail value $150. 1 $100 gift certificate for Unique Bed and Breakfast Inns. 9 gift certificates for $11 each to Rogue Brewery. 2 tickets to KMHD Blues Party III for September 14th. Approximate retail $45 each ticket. Approx. 12 band T-shirts. Approximate retail value $15 each. Approx. 10 autographed band posters. Approximate retail value $5 each. Insurance, all expenses and incidentals not mentioned above (including but not limited to travel to and from the VIP Package show destinations) are the responsibility of each winner. No substitution or transfer of prize or cash redemption is permitted, but Sponsor may at its option substitute cash value or another prize it believes is of equal or greater value. Taxes, if any, are the responsibility of each winner. 4. HOW DO I WIN? Each potential prizewinner will be determined by a series of random drawings from all entries received at the time of each drawing on September 7, 2007. YOU MUST BE PRESENT TO WIN. The number of eligible entries received at the time of the particular drawing will determine odds of winning each prize. All prizes will be awarded. Any potential prizewinner not present at the time of the drawing, who declines to accept the prize, has violated any of these Official Rules, or is found to be ineligible will be disqualified and an alternative potential prizewinner shall be chosen. The potential winner of the Grand Prize may be required to sign/return a Declaration and Release.. Each potential winner’s guests may also be required to sign a Liability/Publicity Release. Each winner releases Sponsor, their affiliated companies and all employees, agents, and representatives from all liability and responsibility of any kind which is related in any way to the prize (including without limitation any property loss, damage, personal injury or death) and consent to the use of their names and likenesses for advertising and promotional purposes without additional compensation, except where prohibited by law. 5. WHO CAN'T PARTICIPATE? Employees, agents, and representatives of Sponsor, and suppliers of the prizes for this promotion, and the immediate families of each of them, are not eligible to win. 6. GENERAL CONDITIONS. Void where prohibited. This contest is subject to all applicable federal, state and local laws and regulations. By entering, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor, whose decisions are final and binding with respect to all matters related to this promotion. Sponsor is not responsible for any printing errors in these Official Rules. Sponsor reserves the right to modify or cancel this promotion at any time and, in the event of cancellation, substitute another in its place. 7. HOW WILL DISPUTES BE HANDLED? Each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Oregon; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this promotion, shall be governed by, and construed in accordance with the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Oregon or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Oregon. 8.
